Criminal Original Petition filed under Section 482 of the Code of Criminal Procedure, praying to direct the respondent to register the complaint of the petitioner dated 13.11.2015 and investigate the case and take action against the said person and prosecute him in accordance with the law. ORDER

This petition is filed for a direction to the respondents to register the complaint given by the petitioner on 13.11.2015 and investigate the case in accordance with law.

The petitioner herein lodged a complaint as against one N.V.Kamalesh Kumar on the allegation of cheating. Though, the complaint has been received by the respondent police, till date no action has been taken. Hence, he came forward with this present petition.

When the matter was taken up for consideration today, the learned Additional Public Prosecutor submitted that on completion of enquiry, the said complaint was closed as it is purely civil in nature.

The learned counsel appearing for the petitioner denies the same.

Considering the submission made by the learned Additional Public Prosecutor, since already the complaint has been closed, this Court cannot give any direction in this petition and hence, this Criminal Original Petition is dismissed. However, the petitioner is at liberty to work out her remedy under Section 156(3) of Cr.P.C., if she is so aggrieved.
