By consent, the writ petition is taken up for final disposal. The petitioner has completed 10th standard and he would state that his father was working as Village Assistant and on account of his health problems, the petitioner was working temporarily as Village Assistant from 01.10.1992 to 31.12.1992 in terms of the proceedings of the Tahsildar, Tittagudi dated 28.09.1992 and also worked in similar capacity from 05.06.1996 to 06.12.1996 and according to the petitioner, during the said period, he discharged his duties to the utmost satisfaction of the superior officers and a certificate of appreciation was also issued to him. It is further
stated that the services of his father were regularised with effect from 01.06.1995 and he retired from service during the year 1999 ; but he was not paid the pension on the ground that he has not put in 10 years of regular/qualified service from the date of his regularization and in this regard, the petitioner's father was regularly corresponding with the authorities concerned and however, no response was forth coming and in the interregnum, the father of the petitioner died. It is the further submission of the petitioner that he sought for employment as Village Assistant by taking into consideration the period of service rendered by him as Village Assistant for about 511 days and also places reliance upon G.O.Ms.No.21, Labour and Employment Department, dated 02.02.2000. In respect of the petitioner's application dated 10.09.2015, he was permitted to write the examination; but the result of the same is yet to be declared and hence, the petitioner came forward with this writ petition.
Heard the learned counsel for the petitioner and Mr.V.Subbiah, learned Special Government Pleader who accepts notice on behalf of the respondents.
Though the petitioner has sought for a larger relief, this Court, in the light of the above facts and circumstances and without going into the merits of the same, permits the petitioner to submit a detailed representation to the respondents 2 and 3 seeking redressal of his grievance within a period of two weeks from the date of receipt of a copy of this order by enclosing a copy of this order and the respondents 2 and 3, on receipt of the same, are directed to consider such representation on merits and in accordance with law and pass orders within a further period of four weeks thereafter and communicate the decision taken to the petitioner. The writ petition is disposed of accordingly. No costs. Consequently, the connected miscellaneous petition is closed. Sd/- Asst.Registrar /true copy/ Sub Asst.
