The petitioners, who were arrested and remanded to judicial custody on 30.03.2024 in Crime No.40 of 2024, for the offences punishable under Sections 380, 34 of IPC, seeks bail.

2. Learned counsel appearing for the petitioners submitted that the petitioners are innocent persons and they are no way connected with the alleged offence, whereas, they have been falsely implicated in this case. He further submitted that the petitioners are suffering incarceration from 30.03.2024 and they are ready to abide any stringent conditions that may be imposed by this Court. Hence, he prayed for grant of bail to the petitioners.

3. Learned Government Advocate (Crl.Side) appearing for the respondent police raised objection for granting bail to the petitioners stating that, petitioners trespassed into the defacto complainant's house and committed theft of 15 sovereign of gold ornaments and cash of Rs.35,000/- He further submitted that, stolen property has not yet been fully recovered and the petitioners have similar previous cases pending against them. Hence, he prayed for dismissal of the petition.

4. Taking into consideration the facts and circumstances of the case and the submission made by the learned counsel on either side and taking note of the the stolen property has not been fully recovered, this Court is not inclined to grant bail to the petitioners.
