Respondents Prayer:- Writ Petition filed under Article 226 of the Constitution of India, praying for issuance of a writ of mandamus directing the respondents to consider the petitioner for selection and appointment to the post of Manager [Transport] in the 4th respondent ED 1116 the Coimbatore District Cooperative Milk Producers' Union Ltd., Coimbatore, in pursuant to the Employment Notification in Advertisement No.4545/ESTT-1/2021 dated 13.01.2021 and as per the written test and oral interview conducted and concluded in the month of February 2021 based on the merit in selection in consideration of representation of the petitioner within a time frame to be fixed by this Court.

ORDER

By consent, the writ petition is taken up for final disposal and disposed of by this order.

Mr.C.Kathiravan, learned Government Advocate accepts notice on behalf of the 1st respondent and Dr.S.Suriya, learned Government Advocate accepts notice on behalf of respondents 2 to 4.

The petitioner has filed the present writ petition seeking for a mandamus to direct the respondent to consider the case of the petitioner for selection and appointment to the post of Manager [Transport] in the 4th respondent pursuant to the Employment Notification in Advertisement No.4545/ESTT-1/2021 dated 13.01.2021 and as per the written test and oral interview conducted and concluded in the month of February 2021 based on the merit in selection by considering his representation of the petitioner within a time frame.

The learned counsel for the petitioner would submit that though the petitioner has submitted the representation dated 15.06.2021 to the 3rd respondent, the 2nd respondent is the competent authority to consider the said representation and hence, prayed that the petitioner may be permitted to submit a fresh representation to the 2nd respondent and the 2nd respondent may be directed to dispose of the same on merits within a stipulated time frame.

This Court heard the rival submissions and also perused the materials placed before it.

This Court, considering the limited scope of prayer now sought for by the petitioner and without expressing any opinion on the merits of the petitioner's representation or the case projected by him in this writ petition, permits the petitioner to submit a fresh representation to the 2nd respondent, who upon receipt of the same, is directed to dispose of the said representation on merits and in accordance with law and pass orders within a period of eight weeks from the date of receipt of the said
representation and communicate the decision taken, to the petitioner herein.

The writ petition stands disposed of accordingly. No costs.
