Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India praying for issuance of Writ of Mandamus directing the respondents to reclassify our land from "Natham" to "Rural Land" and consequently to mutate the Patta and revenue records in favour of petitioner and petitioner's sisters, namely S.Jayalakshmi and S.Rajeswari, in respect of the property measuring an extent of 8 acres and 28 cents in S.No.719/Part, 3 acres and 19 cents in S.No.722/Part, 2 acres and 7 cents in S.No.723/Part and 9 acres and 7 cents in S.No.724/Part, situated at Kottur Village, Anaimalai Taluk, by considering the petitioner's representation dated 05.03.2025.

By consent of learned counsel on both sides, this writ petition is taken up for final disposal at the admission stage itself.

This writ petition is filed praying for a Mandamus directing the respondents to reclassify petitioner's land from "Natham" to "Rural Land" and consequently to mutate the Patta and revenue records in favour of petitioner and her sisters, namely S.Jayalakshmi and S.Rajeswari, in respect of the property measuring an extent of 8 acres and 28 cents in S.No.719/Part, 3 acres and 19 cents in S.No.722/Part, 2 acres and 7 cents in S.No.723/Part and 9 acres and 7 cents in S.No.724/Part, situated at Kottur Village, Anaimalai Taluk, by considering the petitioner's representation dated 05.03.2025.

3. It is submitted by the learned counsel for the petitioner that the petitioner and her sisters viz., S.Jayalakshmi and S.Rajeswari have been

in possession and enjoyment of the properties measuring an extent of 8 acres and 28 cents in S.No.719, 3 acres and 19 cents in S.No.722, 2 acres 7 cents in S.No.723 and 9 acres and 7 cents in S.No.724. The petitioner had taken out a representation for reclassification of the lands in abovesaid survey numbers from Natham land as a Rural land and also to mutate the patta and revenue records in favour of herself and her sisters. Since the petitioner's representation was not considered by the respondents till date, the present writ petition has been filed before this Court.

4. Mr.A.Selvendran, learned Spl. Govt. Pleader appearing for the respondents 1 and 2 would submit that whether the petitioners are entitled for reclassification or otherwise, would be decided by the 1st respondent and orders would be passed, after issuing notice and hearing the petitioner and any other interested partieswithin the time frame fixed by this Court, which was agreed to by the learned counsel for petitioner.

5. In view of the same, taking into consideration the facts and circumstances of the case and the limited relief sought for in this Writ

Petition, there shall be a direction to the official respondents, to consider the representation of the petitioner dated 05.03.2025 seeking reclassification of the subject land from Natham to rural land on its own merits and pass appropriate orders in accordance with law, after affording the petitioner and any other interested parties, a reasonable opportunity of personal hearing, within a period of sixteen (16) weeks from the date of receipt of a copy of this order. It is made clear that this Court has not expressed any views with regard to the merits of the case and it is open to the concerned respondent to consider the matter on its own merits and in accordance with law.

6. Accordingly, the writ petition stands disposed of. There shall be no order as to costs.
