This Criminal Original Petition has been filed by the petitioner/accused, who was arrested and remanded to judicial custody to 25.04.2024, seeking bail in Crime No.187 of 2024 registered for the alleged offences punishable under Sections 294(b), 323, 324, 427, 307 and 506(ii) of IPC.
2. Learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. He further submitted that the petitioner is no way connected with the alleged offence, whereas he has been suffering incarceration from 25.04.2024. He also submitted that the petitioner is ready to abide by any stringent conditions that may be imposed by this Court and hence, he prayed for granting bail to the petitioner.
3. Learned Government Advocate (Criminal Side) appearing for the respondent police raised objection for granting bail to the petitioner stating that due to the political enmity, the accused had abused the de facto complainant and her family and attempted to murder them by attacking with machete, in which, the victims sustained grievous injuries and they are taking treatment in the hospital. He further submitted that there are three accused in this case and the petitioner is arrayed as A2, against whom, there is no previous case, however, if he is released on bail, there is a possibility of him absconding and threatening the witnesses. 4. Heard the learned counsel for the petitioner and the learned Government Advocate (Criminal Side) appearing for the respondent and perused the materials available on record.
5. Taking into consideration the facts and circumstances of the case and considering the gravity and nature of the offence committed by the accused and also taking note of the submissions made by the learned Government Advocate (Crl.Side) that the first accused in this case is still absconding, this Court is not inclined to grant bail to the petitioner.
