O R D E R

The present criminal original petition has been filed seeking direction to the 2nd respondent police to register the complaint given by the petitioner dated 06.11.2015.

2. The petitioner is a flower vendor and the petitioner along with her three siblings were residing at No.14, Eshwaran Kovil Street, Natthakadu, Vennandur, Namakkal District. The petitioner offered to sell a property to one Venkatachalam measuring to an extent of 850 sq.ft. Since the amount offered by the said Venkatachalam is very meager, the petitioner sold the the said property to one Ranjith Kumar by way of Register Sale deed. After seven years, one L.Venkatachalam came with an unregistered document alleging that the petitioner had already entered into an agreement with him on 21.06.2008 with regard to the above said property and as if the petitioner has received a sum of Rs.75,000/- as advance amount. But, the petitioner has not entered any agreement as alleged by the said L.Venkatachalam. However, with an intention to cheat the https://hcservices.ecourts.gov.in/hcservices/

petitioner, the said L.Venkatachalam colluded with S.Velingiri, M.Ravi and V.A.Sasirajmohan had created the false sale deed. Hence, the petitioner has lodged a complaint on 06.11.2015. But till date no action was taken. Hence, the present criminal original petition has been filed.

3. I have heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor appearing for the respondents.

The learned Additional Public Prosecutor submitted that on the basis of the complaint given by the petitioner, en qnuiry was conducted by the Anti Land grabbing Cell, Namakkal and since the complaint does not disclose any cognizable offence, the same was closed and the parties are advised to approach the civil Court for their remedy.

5. Based on the submission made by the learned Additional Public Prosecutor, this Court is of the opinion that there is no need to give any specific direction to register the complaint.
