ORDER

The petitioner has filed the writ petition directing the respondents 1 and 2 to consider the representation dated 13.09.2017 of the petitioner and select the petitioner to the post of Grade-II Police Constable/Jail Warden/Fire Man for the selection of the year 2017, as the petitioner has secured more marks than that of the selected candidates marks in the category of Scheduled Caste-General.

2.Heard both sides and by consent of both, the main writ petition is taken up for final hearing.

3. The learned counsel for the petitioner submitted that the petitioner, who belongs to Hindu Schedule Caste Community, applied for the post of Grade II Police Constable in Armed Reserve. He had secured overall 68% marks - 56 marks in written exams - 12 marks in physical test. The respondents also fixed the cut off mark for Scheduled Caste category as 68% and they have selected the candidates, who secured 68%, but, they have overlooked the case of the petitioner. Therefore, a direction be issued to the respondents.

4.The learned Special Government Pleader, by producing OMR Sheet before this Court, submitted that the petitioner has opted to be appointed in Armed Reserve Police Constable alone, for which, the respondents have fixed cut off mark as 74% for Schedule Caste Category.

5.Since the petitioner secured only 68%, admittedly, he is ineligible to be considered. Under such circumstances, this Court is not inclined to entertain the writ petition. The writ petition fails and the same is dismissed. No costs. Consequently, connected WMP is closed.
