ORDER

The present criminal original petition has been filed seeking a direction to the first respondent police to give necessary directions to the third respondent police to register a case, based on the petitioner's complaint dated 5.11.2015.

2. It is the case of the petitioner that due to previous enmity, on 31.10.2015, at about 20.30 hours, some of the residents of his apartment viz., P.Balachandar, Jayashree Rajagopal, Sabitha Parthasarathy, S.Balakrishnan and Rama Sankararaman trespassed into his flat and created all sorts of nuisance and tortured the petitioner and his mother and caused simple injury. Hence, the petitioner lodged a complaint with https://hcservices.ecourts.gov.in/hcservices/

the first respondent police on 5.11.2015, who in turn, forwarded the same to the second respondent police. But, till date, the second respondent police did not take any action on the said complaint. Hence, the petition.

3. Learned Additional Public Prosecutor submitted that on receipt of the complaint, a detailed enquiry was conducted and the said complaint was closed by the respondent police. He has also produced a copy of the closure report before this Court.

4. Since the complaint given by the petitioner has already been closed, nothing survives in this petition and the prayer that has been made in this petition has become infructuous.

Hence, the criminal original petition is dismissed. However, the petitioner is at liberty to work out his remedy in a manner known to law, if he is so advised. sbi s/d- Assistant Registrar(CO) True Copy Sub-Assistant Registrar To
