O R D E R

The present criminal original petition has been filed seeking direction to the respondent to register a case based on the complaint of the petitioner dated 07.10.2015 and investigate the same in accordance with law.

2. The petitioner herein alleged that he had entered into a sale agreement on 08.04.2015, registered as Doc.No.1518 of 2015 with one Balappa towards purchase of the property. It is seen that the said Balappa had executed the sale deed in favour of C.C.Chinappan, who is working as Headmaster at Immidinaickanahalli High School, Soolagiri Union. With an ulterior motive to cheat the petitioner and to grab his property, the said Balappan and C.C.Chinnappan, created forged documents and registered the sale deed in their favour. the petitioner lodged a complaint before the respondent police on 07.10.2015. Though the complaint has been received by the respondent police and CSR.No.405 of 2015 has been assigned, till date no action has been taken. Hence, the present criminal original petition has been filed.

4. The learned Additional Public Prosecutor submitted that the matter appears to be civil in nature an no cognizable offence is made out. Thus, opposed to give a direction as prayed for.

3. I have heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor appearing for the respondents.

5. In view of the submissions made on either side, since a complaint is pending under C.S.R.No.405 of 2015, this Court directs the respondent police to conduct enquiry on the complaint given by the petitioner dated 07.10.2015, which has been assigned C.S.R.No.405 of 2015 and dispose of the same in accordance with law, as early as possible.

6. This criminal original petition is disposed of accordingly.
