O R D E R
The instant writ petition has been filed with a prayer for issuing a Mandamus, directing the respondents herein to revise the petitioner's pension by taking his entire qualifying pensionable service from 01.12.1990 to 06.01.2025 and pay the consequential retirement benefits for the entire service of 34 years to the petitioner herein, by considering the representation of the petitioner dated 22.03.2025.
2. The learned counsel for the petitioner would submit that the petitioner has joined as a Trainee on 20.10.1986 in the RespondentsCorporation and subsequently, he was regularised with effect from 01.12.1990. It is the further submission of the petitioner that he voluntarily 2/6
retired from service on 06.01.2025. While settling the pension, the 2nd respondent has paid pension by taking into consideration of his service from 2000 to 2025 instead of taking his date of initial regularisation of the year 1990. Hence, the petitioner has sent a representation on 22.03.2025 for modifying the pension and such representation is yet to be considered by the respondents. The learned counsel for the petitioner would also submit that similar case was decided by this Court in W.P.No.2130 of 2023, dated 30.01.2023 and subsequently, the said order was implemented.
3. Mr.L.S.M.Hasan Fizal, learned Additional Government Pleader takes notice for the 1st respondent and Mr.C.S.K.Sathish, learned Standing Counsel takes notice for the 2nd respondent.
4. The learned Additional Government Pleader for the 1st respondent would admit the receipt of the representation dated 22.03.2025 and the same is yet to be considered.
5. In view of the same, instead of going into the merits of the matter, this Court deems it appropriate to direct the respondents to consider the 3/6
representation of the petitioner dated 22.03.2025 on it's own merits and in accordance with law, within a period of six weeks from the date of receipt of copy of this order.
