O R D E R

The Sale Deed dated 13.06.2001 was referred to the respondent no.2 for adjudication under Section 47 A of the Indian Stamps Act. The petitioner has also made a representation on 24.01.2002. Seeking conduct of an enquiry and with a request to consequently release the document, the present Writ Petition has been filed.

2.The law is quite settled that a document cannot be with held on the ground of under valuation. Thus, a direction is issued to the respondent nos.2 & 3 to return the document of the petitioner with an endorsement that Section 47 (A) proceedings are pending and subject to other conditions to be imposed within a period of six weeks from the date of receipt of a copy of this order. The respondent nos.2 & 3 are also directed to conclude the proceedings under Section 47 (A) of the Act within a period of eight weeks from the date of receipt of a copy of this order.
