CRL. O.P. No.17641 of 2016 S.VAIDYANATHAN, J.

Apprehending arrest at the hands of the respondent police for the alleged offence punishable under Section 21(1) of Mines and Minerals Act 38(A) M.M.Regulation Act r/w.379 of IPC in Crime No.558 of 2016 on the file of the respondent police, the petitioner has come forward with this petition seeking anticipatory bail.

2. The case of the prosecution is that the petitioner along with other accused is alleged to have illegally transported 35 tonnes of sand in their 12 wheeler lorry.

3. Learned Government Advocate (Crl.

Side) submitted that the petitioner has committed theft of huge quantity of sand and hence, opposed for grant of anticipatory bail to the petitioner.

4. Learned counsel for the petitioner submitted that the petitioner has not committed any such offence and a false case has been foisted against him.

5. Taking note of the fact that huge quantity of sand has been transported by the petitioner, this Court is not inclined to grant the relief sought for by the petitioner and this petition is dismissed.
