ORDER : The Court Made the following order :- The petitioner, who was arrested and remanded to judicial custody on 09.06.2020 for the offence under Sections 395, 397 and 457 of IPC, in S.C.No.108 of 2018 on the file of the learned Principal District Sessions Judge, Tiruppur, in Crime No.136 of 2016 on the file of the respondent police. seeks bail.
2. This is the fifth bail application filed before this Court. It is the case of jumped bail. The petitioner is arrayed as the second accused and facing trial in S.C.No.108 of 2018 on the file of the learned Principal Sessions Judge, Tiruppur, for the offences under Sections 395, 397 and 457 of IPC, 1860. Since the petitioner did not appear before the Trial Court on 08.01.2020, the learned Judge had issued Non-bailable Warrant of arrest against the petitioner.
3.The learned counsel appearing for the petitioner would submit that the petitioner has not committed any offence as alleged by the prosecution and he has been falsely implicated in this case. Hence, he prays for grant of bail to the petitioner. 4.The learned Government Advocate (Crl. Side) submitted that earlier bail applications were dismissed by this Court in Crl.O.P.Nos.16336 and 18761 of 2020 and Crl.O.P.No.2697 and 7598 of 2021. He further submits that there are seven previous cases pending as against the petitioner and he is a habitual offender. 5.Considering the fact that there are seven previous cases pending as against the petitioner and earlier petitions were dismissed by this Court and there is no change of circumstances, this Court is not inclined to grant bail to the petitioner. 6.Accordingly, this Criminal Original Petition is dismissed. -sd/- 03/08/2021 This order, on being produced, be punctually observed and carried into execution by all concerned TRUE COPY Sub-Assistant Registrar (Statistics/C.S.)
