This application has been filed to bring the proposed parties who are the legal heirs of the deceased defendant as D2 to D4.

2. Earlier the application filed to condone the delay in setting aside the abatement caused due to the death of the defendant and to set aside the abatement have been allowed.

3. Since the proposed parties have to be necessarily impleaded as legal heirs of the deceased defendant, in the interest of justice, this application is allowed.
