PRAYER: Writ Petition is filed under Article 226 of Constitution of India, pleased to issue a Writ of Prohibition, prohibiting the Respondent from taking any action in respect of the complaint given by one Mr.Alok Kumar Chaturvedi and Mr.Sathish Ramakrishnan in respect of property situated at No.169, Dr.Najunda Road, Injambakkam village Chengalpet District. O R D E R

The Writ Petition has been filed to prohibit the Respondent from taking any action in respect of the complaint given by one Mr.Alok Kumar Chaturvedi and Mr.Sathish Ramakrishnan in respect of property situated at No.169, Dr.Najunda Road, Injambakkam village Chengalpet District.

2. The learned Counsel for the petitioner submitted that based on the advertisement of M/s.Simpcon Developers, a construction company, petitioner and her husband one M.K.Venkatasubramanian decided to purchase the above mentioned property. Further submitted that the petitioner and her husband had purchased the above mentioned property by way of a Sale

Deed. Now, it appears that the promoter is already executed some document in favour of the de facto complainant. In pursuant to the complaint of the de facto complainant, the respondent Police had made a repeated calls against the petitioner for enquiry.

3. The learned Additional Public Prosecutor appearing for the respondent Police submitted that there is a complaint as against the petitioner and enquiry is pending and will take appropriate action within a period of two weeks.

4. Such view of the matter, the petitioner shall appear before the respondent Police for enquiry and after all, the petitioner appears to be subsequent purchaser. Therefore, the Police shall take into consideration of the above aspect and proceed against the real culprit.

5. With the above direction, this Writ Petition stands disposed of. No costs. Consequently, connected miscellaneous petition stands closed.
