O R D E R

The instant writ petition has been filed with a prayer for issuing a Mandamus, to direct the 1st respondent to consider the representation of the petitioner to reinstate him into the service by posting him in any nonsensitive post in any place.

2. The learned counsel for the petitioner would submit that on the basis of a false complaint, he was suspended from service on 17.08.2024, and for almost one year, he is under suspension, the respondents have not reviewed the suspension.

3. It is the further submission of the learned counsel for the petitioner that he has also given representation dated 12.11.2024 to the 1st respondent. Since, there was no response from the 1st respondent, the petitioner filed the present writ petition.

4. The learned Government Advocate for the respondents would submit that investigation has been completed and sanction from the competent authority is awaited.

5. Heard the learned counsel for both sides and perused the materials available on record.

6. Though there is disputed facts between the parties, taking into consideration of the fact that the representation made by the petitioner is yet to be considered, this Court without going into merits of the matter, deems it appropriate to direct the 1st respondent to consider the representation of the petitioner dated 12.11.2024 and pass order on it's own merits and in accordance with law, within a period of eight weeks from the date of receipt of a copy of this order.

7. In the result, this Writ Petition is disposed of with the above observations. No costs.
