Respondent PRAYER: Criminal Miscellaneous Petition is filed under Section 482 of Criminal Procedure Code praying to modify the order dated 04.03.2020 passed in Crl.O.P.No.4901 of 2020 on the file of this Hon'ble Court, modify the condition that the petitioner is directed to deposit the original title deed of property for the guideline value of Rs.22,00,000/- standing in the name of the petitioner or in the name of the relatives along with valuation certificate obtained from the concerned authorities in Kerala to the credit of Crime No.02 of 2020 before the concerned magistrate.

O R D E R

(The case has been heard through video conference) This petition has been filed to modify the order dated 04.03.2020 passed in Crl.O.P.No.4901 of 2020 directing the petitioner to deposit the original title deed of property for the guideline value of Rs.22,00,000/- standing in the name of the petitioner or in the name of the relatives along with the valuation certificate obtained from the concerned authorities in Kerala to the credit of Crime No.02 of 2020 before the concerned Magistrate.

The learned counsel for the petitioner would submit that the petitioner was arrested on 21.01.2020 in Crime No.02 of 2020 by the respondent police for the offences punishable under sections 409, 420, 467, 477A and 120B IPC. He would further submit that this Court was pleased to grant bail to the petitioner in Crl.O.P.No.4901 of 2020 dated 04.03.2020 with a condition that the petitioner shall deposit the original title deed of property for the guideline value

of Rs.22,00,000/- standing in the name of the petitioner or in the name of her relatives along with the valuation certificate obtained from the concerned revenue authorities in Kerala to the credit of Crime No.02 of 2020 before the concerned magistrate. He would further submit that though the order has been passed on 04.03.2020, the petitioner was unable to obtain the valuation certificate from the concerned revenue authorities in Kerala due to Covid pandemic and thereby the petitioner is unable to come out on bail. He further submitted that the petitioner is prepared to deposit the title deed of the residential property value more than 25 lakhs which stands in the name of the father of the petitioner viz., Vijaya Ragavan Nair and her father is also prepared to stand as a surety. Hence, he prays that the condition to furnish valuation certificate obtained from the concerned revenue authorities in Kerala may be dispensed with.

3. Heard the learned Additional Public Prosecutor appearing for the respondent.

Taking into consideration the facts and submission made by the learned counsels, this Court is inclined to modify the condition 7(b) to the effect that the petitioner is directed to deposit the original title deed of the residential property which stands in the name of the father of the petitioner viz., Vijayaragavan Nair registered as Document No.3801 /2011 at SRO, Chittur, Palacode, to the credit of Crime No.02 of 2020. The other conditions shall remain unaltered.

5. With the above directions, this criminal miscellaneous petition is ordered.
