Order This writ petition has been filed for the issuance of a writ of mandamus directing the respondent to regularise the period during which the petitioner was removed from service and sanction all service benefits, retirement benefits, and other eligible monetary benefits payable to the petitioner, and to pay regular pension to him by considering the petitioner's representation dated 15.07.2024 within a time to be stipulated by this Court.

2. The petitioner would submit that he was appointed as a Village Administrative Officer under the respondent-Department. While serving at Reddipalayam Village in Ariyalur District, a vigilance trap was conducted on 26.05.2004, following which a criminal case was registered against him for the offences under Section 7 and 13(2) read with 13(1) d of the Prevention of Corruption Act, 1988. The petitioner had attained the age of superannuation on 29.03.2009 and was removed from service due to the pendency of the criminal proceedings. Subsequently, by judgment dated 27.02.2018 in Spl. Case No.01 of 2012, the learned Chief Judicial Magistrate/Special Judge, Ariyalur, convicted and sentenced the petitioner. Aggrieved by the same, the petitioner had preferred a Criminal Appeal No.158 of 2018 before this Court.

3. The petitioner would further submit that this Court, by judgment dated 05.02.2024 in Crl.A. No.158 of 2018, allowed the appeal and acquitted him of all charges. Following his acquittal, the petitioner submitted a representation dated 15.07.2024 seeking regularisation of the period during which he remained out of service and sanction of pensionary, retirement and other benefits. Since the said representation has not been acted upon, the petitioner has approached this Court seeking the aforesaid relief.

4. Heard the learned counsel for the petitioner and the learned Government Advocate appearing for respondents.

5. Considering the limited scope of the prayer sought in this writ petition, and without expressing any opinion on the merits of the case, this Court directs the respondent to consider the petitioner's representation dated 15.07.2024 and pass appropriate orders on merits and in accordance with law, within a period of four weeks from the date of receipt of a copy of this order.
