PRAYER: Writ Petition is filed under Article 226 of Constitution of India, pleased to issue a Writ of Mandamus, directing the seventh respondent police to break open the lock, locked by the seventh respondent police in the building of Friends Recreation Club at Old No.154-A, New No.150, River Side North Street, Salem - 1 and to hand over the key to the petitioner.

O R D E R

This Writ Petition has been filed seeking a writ of mandamus, to direct the seventh respondent police to break open the lock, locked by the seventh respondent police in the building of Friends Recreation Club at Old No.154-A, New No.150, River Side North Street, Salem - 1 and to hand over the key to the petitioner.

2.The case of the petitioner is that the fourth respondent had foisted a false case against the petitioner club alleging that gambling is taking place in the club by setting up a stock witness and thereupon, the petitioner's premises has been locked by the seventh respondent, which they seek to be removed.

3.Today, when the matter is taken up for hearing, the learned Additional Public Prosecutor would submit that the seventh respondent has not locked the premises.

4. In view of the above submission made by the learned Additional Public Prosecutor, this court is of the view that no relief requires to be granted in the present writ petition. Accordingly, the Writ Petition stands disposed off. Consequently, the connected miscellaneous petition is closed. s/d- Assistant Registrar True Copy Sub-Assistant Registrar
