.. Respondent PRAYER:- Writ petition filed under Article 226 of the Constitution of India praying to issue an order of direction in the nature of writ of Mandamus directing the respondent to dispose my representation dated 01.02.2017 within time bound manner.

ORDER

Though, the relief sought for by the writ petitioner in this Writ Petition is only for a direction to dispose of the representation dated 01.02.2017, the same cannot be granted in a routine manner, since, this Court is of the view that no cause for filing of this writ petition has been shown in the affidavit filed in support of this writ petition.

The representation submitted by the writ petitioner relates to his promotion. Admittedly, even the panel has not been prepared nor any letter or document showing that the respondent have proposed to finalize the panel is enclosed. Hence, the petitioner has not established even a semblance of legal right to move the writ petition under Article 226 of the Constitution of India. In the absence of any right, this Court cannot issue any writ against the respondent. The mere apprehension is not sufficient to entertain the writ petition. 3.

Further, in the case on hand, except stating that the petitioner submitted the representation seeking his promotion, there is no proof to show that the respondent has initiated https://hcservices.ecourts.gov.in/hcservices/

action to prepare the panel to effect promotion. The writ petitioner as on today is not an aggrieved person. 4.

In this view of the matter, the writ petition is premature and especially, no cause for entertaining the writ is established.
