Mr.P.Senthilvel, learned Government Advocate takes notice for the respondents. By consent of the parties, the main writ petition itself is taken up for final disposal at the admission stage itself.
2. The petitioner seeks for the following relief: Directing the 4th respondent to survey the land in Survey No.53/1 to an extent of 0.95 cents in Kaggannur Village, Hosur Taluk, Krishnagiri District in the light of the order passed by https://hcservices.ecourts.gov.in/hcservices/
the 2nd respondent through his proceedings in Na.Ka.No.32906/15/J2 dated 30.08.2017 and consequently, direct the 4th respondent to issue patta in the petitioner's name by considering the petitioner representation dated 06.10.2017.
3. It is seen that the petitioner sought for survey of the land and issuance of Patta in his name in respect of the subject matter land. The petitioner has sought such relief based on the proceedings of the second respondent dated 30.08.2017, seeking for survey of the land.
4. This Court, at this stage, is not expressing any view on the claim made by the petitioner, as it is for the respondents to consider and decide, based on the merits of the matter. It is further seen that the petitioner has made further representation on 16.10.2017 seeking for the very same relief and it is stated that the said representation is still pending. Therefore, without expressing any view on the merits of the matter, this writ petition is disposed of, only by directing the fourth respondent to consider the claim of the petitioner and pass orders on the same on its own merits and in accordance with law, after giving due opportunity of hearing to the petitioner as well as the rival claimants, if any, within a period of eight weeks from the date of receipt of a copy of this order. No costs.
