The present criminal original petition has been filed to direct the respondent to register a complaint dated 25.09.2015 given by the petitioner.

The petitioner herein lodged a complaint on 25.09.2015, stating that his wife eloped with one Kumar @ Sivakumar along with jewellery and cash of Rs.1,00,000/- from the petitioner's house. Though C.S.R.No.319 of 2015 has been assigned on the complaint of the petitioner, till date no action has been taken. Hence, the present criminal original petition has been filed.

3. I have heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor appearing for the respondents.

4. The learned Additional Public Prosecutor submitted that on receipt of the complaint of the petitioner, C.S.R.No.319 of 2015 has been assigned and the matter is pending enquiry. He further submitted that the complaint do not constitute any congnizable offence and the petitioner has to work out his remedy in the manner known to law and thus, opposed to grant any direction as sought for by the petitioner.

5. In view of the submissions made on either side, this Court directs the respondent to conduct enquiry on the complaint given by the petitioner dated 17.02.2015 in C.S.R.No.145 of 2015 and dispose the same in accordance with law, as early as possible.

6. This criminal original petition is disposed of accordingly.
