Writ petition filed under Article 226 of the Constitution of India praying for issuance of Writ of Mandamus to direct the respondents to consider the petitioner's representation dated 11.05.2019 and granting permission/certificate of to continue to run the bunk shop (Thallu Vandi) and till such time not to disturb to running of petitioner's Bunk Shop situated at United India Colony 2nd Street, Kodambakkam, Chennai - 600 024.

ORDER

Mr.V.C.Selvasekaran, learned Standing Counsel takes notice for the respondents. By consent, the Writ Petition is taken up for final hearing at the admission stage itself.

2. The petitioner has come up with the present Writ Petition seeking direction to the respondents consider his representation dated 11.05.2019 for granting permission/certificate to continue

to run the bunk shop (Thallu Vandi) situated at United India Colony 2nd Street, Kodambakkam, Chennai - 600 024 and till such time not to disturb his business.

3.According to the petitioner, he is having 70% disability and had completed 10th Standard and running a bunk shop at United India Colony 2nd Street, Kodambakkam, Chennai - 600 024 without any hindrance to traffic or pedestrians. The petitioner would further submit that the respondents had inspected his bunk shop and advised him to obtain appropriate permission/certificate from the respondents to run the bunk shop. Hence, he submitted a representation to the respondents on 11.05.2019 seeking permission/certificate to continue the bunk shop, but so far, no order has been passed. Therefore, the present writ petition. 4.The learned Standing Counsel for the respondents submitted that they would consider the representation of the petitioner on merits and in accordance with law.

5. In the light of the above facts and submissions, this Court, without going into the merits of the case, directs the respondents to consider the representation of the petitioner dated 11.05.2019 and pass appropriate orders, on merits and in accordance with law, within a period of three months from the date of receipt of a copy of this order, after providing an opportunity of hearing to the petitioner.
