ORDER

This Criminal Original Petition has been filed to direct the learned Metropolitan Magistrate Fast Track Court No.II, Egmore, Chennai to complete the trial in C.C.No.6549 of 2016 as a summary case under Sec.143 of Negotiable Instrument Act, 1881 as amended within a stipulated time.

2.The learned counsel appearing for the petitioner would submit that though the statutory procedure under Sec.143 of Negotiable Instrument Act is a summary case, the learned Magistrate mechanically converted into a summons case. He would also submit that even though the learned Magistrate commenced the hearings as early as in the year 2016, it has not disposed of the case in C.C.No. 6549 of 2016 till date.

3. Heard the learned counsel for the petitioner and perused the entire materials available on record.

4. On perusal of the docket order, it appears that there were 27 hearings, even after the petitioner's deposition, the case is adjourned and it has been protracted without any valid reasons. Such view of the matter, there shall be a direction to the learned Metropolitan Magistrate (Fast Tack Court-II), Egmore, Chennai to dispose of the main case in C.C.No.6549 of 2016 on merits within a period of four months from the date of receipt of a copy of this Order.

5. With the above direction, this Criminal Original Petition is disposed of.
