ORDER
This writ petition has been filed challenging the impugned proceedings of the 1st respondent dated 11.8.2023 and for a consequential direction to the respondents to sustain the allotment made in favour of the petitioner. 2.Heard the learned counsel for the petitioner and the learned counsel for the respondent.
3.It is an admitted case that the original allotment was made in favour of one Mathrubootham. It is also an admitted case that the legal heirs of Mathrubootham are R4, R5 and R6. The petitioner claims to be a person who took care of Mathrubootham and on that basis, he has managed to get the allotment transferred in his name through proceedings dated 05.4.2023. On the complaint made by the 6th respondent, the same has been cancelled through the impugned proceedings dated 11.8.2023. 4.It is quite surprising that the petitioner has been recognized as the legal heir of Mathrubootham on the only ground that he took care of Mathrubootham. The actual 2 / 4
legal heirs are R4 to R6. There is something more than what meets the eye in this case. The proceedings dated 05.4.2023 is per se illegal since the allotment has been made in favour of the petitioner by recognizing him as a legal representative of Mathrubootham. Subsequently, it has been rightly cancelled through the impugned proceedings dated 11.08.2023.
5.The impugned proceedings dated 11.8.2023, issued by the 1st respondent does not suffer from any illegality warranting the interference of this Court. Accordingly, this writ petition stands dismissed. No costs. Consequently, connected miscellaneous petition is closed.
