BHARATHA CHAKRAVARTHY CRIMINAL MISCELLANEOUS PETITION No.7878 of 2022 IN CRL RC.770 of 2022 MANOHARAN [ PETITIONER / APPELLANT ] Vs STATE OF TAMILNADU [ RESPONDENT ] REP BY THE INSPECTOR OF POLICE, MELMARUVATHUR POLICE STATION, Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to exempt the petitioner from surrender from the conviction and sentence passed vide Judgment dated 05.04.2022 made in C.A No.11/2019 on the file of the Principal District and Sessions Court, Kanchipuram district at Chengalpattu confirming the Judgement dated 29.01.2019 made in CC.No.16/2015 on the file of the Judicial Magistrate Court, maduranthakam.

Order : This petition coming on for orders upon perusing the petition and the filed in support thereof and upon hearing the arguments of M/S. T.P.PRABAKARAN, Advocate for the petitioner and of MR.S.VINOTH KUMAR, Govt. Advocate (Crl. Side) on behalf of the Respondent the court made the following order:- This petition is filed on the ground that the petitioner has got a mentally retarded child and except the petitioner, there is nobody else to look after the child. The medical records of the child issued by the Department for Rehabilitation of the Disabled, Government of Tamil Nadu is also produced along with typed set of papers. A perusal of the same shows that the child is 100% mentally retarded. In the petition, it is mentioned that the petitioner is raising the child as a single father and there is nobody else to look after the child. https://hcservices.ecourts.gov.in/hcservices/

Therefore, I am of the view that this is an extraordinary case where exemption from surrender has to be granted and accordingly, this petition is ordered as prayed for.
