This matter is taken up for hearing under the caption "For Being Mentioned" today at the instance of the learned counsel for the revision petitioner.
2. The learned counsel for Revision Petitioner would submit that this Court by an order dated 16.11.2023 disposed of the above C.R.P.. However, the learned counsel would submit that as there is some modification in para 3 of the said order, he prayed to modify the same. Accordingly, the matter is listed today.
3. Heard the contentions of learned counsel for revision petitioner as well as respondents and perused the order.
4. Considering his submissions, para 3 of the order shall be substituted as follows :- "3. Records perused. On perusal of records, it would show that so far, the trial was not begin and only interim applications are under enquiry and the records ought to have been called for. Furthermore, calling upon the records would 1/3
minimise the court work. Therefore, the order passed by the trial judge in I.A.No.117 of 2023 in O.S.No.14 of 2022 and the said application is ordered to be allowed. The trial judge is directed to call for records as per the relief claimed by the Revision Petitioner and try along with I.A.No. 34 of 2022 filed by the plaintiff under Order 39 Rule 1 of C.P.C. seeking for the relief of interim injunction. Accordingly, this Civil Revision Petition is disposed of. No costs. Consequently, the connected Civil Miscellaneous Petition is closed."
5. Registry is directed to incorporate above correction in the Order of this Court in C.R.P.No. 1680 of 2023 dated 16.11.2023 and issue fresh order copy to the Revision Petitioner. 22.11.2023 rpp N.B. : Issue order copy today 2/3
