O R D E R

The petitioner seeks a direction to direct the second respondent to grant permission to conduct the dance programme on 05.06.2019 in Arulmighu Mariamman Temple situated in Thammagoundanoor Village, Bargur Taluk, Krishnagiri District.

The learned counsel appearing for the petitioner submitted that the petitioner is a resident of Thammagoundanoor Village, Sigaralapalli post, Bargur Taluk, Krishnagiri District and also claims to be the Dharmakartha of Arulmighu Mariamman Temple situated therein. The festival will be grandly celebrated in his village in the said Temple for two days and as a part of the festival, cultural programmes are being arranged on every day. He would submit that on 05.06.2019, a dance programme was scheduled to be conducted and regarding the same a representation was made to the second respondent on 24.05.2019. However, the second respondent police have orally rejected the https://hcservices.ecourts.gov.in/hcservices/

representation made for the dance programme. Hence, the present Writ Petition has been filed.

3. Heard the learned Government Advocate appearing for the respondents.

At the outset, I am not inclined to grant such a prayer because in general, in the name of cultural programmes, it came to light that some obscene activities leading to group/communal clash are taking place, resulting in filing of many cases against each group. In order to put an end to such activities and to maintain peace and tranquillity, this Court is of the view that the writ jurisdiction cannot be used to direct such authorities to grant permission to conduct the cultural programme. However, it is for the concerned Law and Order Agency to take a decision whether or not such permission has to be granted by taking into consideration of the overall ground situation and the reality in that area.

With the above observations, this Writ petition stands dismissed. No costs.
