JUDGMENT

Both counsel present.

2. It is represented by the appellant counsel that the sole appellant died as early as on 05.10.2015 and the appeal may be dismissed as abated. Endorsement has also been made to that effect by the counsel for the appellant.

3. In the light of the above position, inasmuch as the appellant had died long back and steps had not been taken to proceed with the matter, there is no purpose in keeping the second appeal further pending.

4. Resultantly, the Second Appeal is dismissed as abated. No costs. Consequently, connected miscellaneous petition, if any, is closed.
