Order : This petition coming on for orders upon perusing the petition and the filed in support thereof and upon hearing the arguments of M/S S.P.YUARAJ, Advocate for the petitioner and of M/S. C.E.PRATAP, Govt. Advocate ( Crl. Side) on behalf of the Respondents the court made the following order:- The present petition has been filed to modify the condition imposed on the petitioner in Para 6(b) of the order dated 22.06.2021 passed by this Court in Crl.O.P.No.10594 of 2021
2. This Court, vide order dated 22.06.2021, on the submission of the petitioner that on his own volition, he is ready to make a fixed deposit of a total of Rs.3,00,000/-(Rupees Three Lakhs only) in the name of the two minor children of the deceased (R.1,50,000/- each), within a period of two weeks from 22.06.2021, directed grant of anticipatory bail. .
3. The learned counsel for the petitioner submitted that the petitioner is the only bread winner of the family and also he is no way connected and he is not selling the gun powder. Hence, he prays for modify the condition imposed on the petitioner relating to deposit.
4. The learned Government Advocate (Crl.Side) submits that the petitioner is not complying with the conditions imposed by this Court.
5. Considering the facts the petitioner has not complied with the conditions imposed by this Court in Cr.O.P.No.10594 of 2021 dated 22.06.2021, further he has also not inclined to deposited the amount which he had undertaken to deposit on his own volition, this Court is not inclined to modify the conditions imposed on the petitioner.
6. Accordingly, this Criminal Miscellaneous Petition is dismissed.
