O R D E R

This petition is filed to direct the respondent to register the complaint filed by the petitioner dated 12.12.2015 and investigate the matter.

2. The petitioner submitted that on 11.12.2015 at about 8.00 pm., the counter petitioner, Dhanapal received a sum of Rs.34,500/- from the petitioner and when the petitioner asked him to return the amount, there was a quarrel between them, in which, the petitioner was assaulted by the counter petitioner severely with wooden sticks. Hence, the petitioner was admitted in the hospital and took treatment as out-patient. Thereafter, the petitioner lodged a complaint with the respondent police on 12.12.2015. Since no action was taken so far, the present petition has been filed.

3. Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor appearing for the respondent.

4. The learned Additional Public Prosecutor submitted that the petitioner has sent the complaint only by post. If the petitioner gives a complaint in person, necessary action will be taken.

5. Considering the submissions made on either side, this Court directs the petitioner to give a fresh complaint to the respondent police along with the wound certificate and a copy of this order within a period of one week from the date of receipt of a copy of this order. On receipt of the said complaint, the respondent police is directed to conduct an enquiry and upon enquiry, if the materials are gathered indicating any cognizable offence, he is directed to proceed further in accordance with law as early as possible.

6. The criminal original petition is disposed of accordingly.
