W.P.No.2849 of 2018 is filed under Article 226 of the Constitution of India, praying for the issue a Writ of Mandamus directing the second respondent to place the petitioner in the Assistant Engineer Seniority list as per the Hon'ble High Court
order dated 03.06.2016 in WP (MD) No.2040 of 2006 and batch by considering his representation dated 12.12.2017. For Petitioners:: Mr.V. Stalin For Respondents:: Mr.P.R. Dhilip Kumar Standing Counsel COMMON ORDER The Petitioners, who are serving as Assistant Engineers in the respondent The Tamil Nadu Electricity Generation and Distribution Corporation, were issued with tentative seniority list on 6.11.2017 showing their rank as 522 (the petitioner in WP No.2848 of 2018) and 523 (the petitioner in WP No. 2849 of 2018). As the petitioners were gravely affected and aggrieved by their seniority position in the tentative list and as per the instructions given in the list calling for objections, submitted their objections.

Detailed objections have also been submitted on 22.6.2016, 9.11.2017 in addition to one other representation submitted previously on 26.02.2016. But they have not been considered by the respondents and without doing so, they have proceeded to issue the final list. Therefore, the petitioners have come to this Court to consider their objections. 3.
Mr.P.R. Dhilip Kumar, learned Standing Counsel appearing for the respondents, taking instructions from his Officer, who is also present today, submitted that if the petitioners had submitted their objections within time as stipulated in the list, their objections will be considered. 4.
Placing on record the submissions made by the learned Standing Counsel, the third respondent is directed to consider the objections of the petitioners and pass orders on merits and place the petitioners in appropriate place.
