Prayer : Petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the 1st Respondent to take necessary action against the 3rd Respondent on the basis of the petitioner's representation dated 03.12.2014. O R D E R

The relief sought for in this writ petition is for a direction to take necessary action against the 3rd Respondent on the basis of the petitioner's representation dated 03.12.2014.

2. The writ petitioner has raised certain allegations against the special officer of the Co-operative Societies, Cooperative Agricultural and Rural Development Bank Limited, Nilgiris.

3. The writ petitioner wants to initiate action against a special officer on account of certain allegations of commissions and omissions against him in his personal capacity. Such a complaint has to be pursued in the manner known to law and this Court cannot entertain the writ petition in this regard. There are ways and means to prosecute the public officials, if they have committed an offence under any law, but by seeking a prayer to consider the representation against the co-operative societies, is not maintainable.

4. This Court cannot entertain a writ petition under Article 226 of the Constitution of India. Further, provisions are available under the Tamil Nadu Co-operative Societies Act to initiate action. Thus, the very relief sought for in this writ petition deserves no further consideration.

5. Accordingly, the writ petition stands dismissed. However, there is no order as to costs.
