This application has been filed to Direct the Defendant to remain physically present before the court for the purpose of the Cross-Examination. 2.There is no representation for the learned counsel for the applicant. 3.Learned counsel for the respondent/defendant is present and submits that earlier, an application in A. No. 3715 of 2024 has been filed by the respondent/defendant and this Court by orders dated 03.09.2024 and 29.10.2024 has allowed the defendant to appear through hybrid mode as and when required by this court or before the Master court or for recording evidence and if she has difficulties she is at liberty to appear as she wishes at her convenience. 4.It is seen from the records that the plaintiff has filed this application, contra to the orders passed by this Court, seeking direction to physically present for the purpose of cross examination and having filed this application, the learned counsel for the plaintiff is not present before this Court. 2/4
5.In view of the above, this application is dismissed for non-prosecution. No costs.
