Respondent in both SAs COMMON PRAYER : Second Appeals are filed under Section 100 of C.P.C., to set aside the judgment and decree passed in A.S.Nos.20 and 21 of 2015 dated 12.07.2016 on the file of the Principal District Judge, Erode in reversing the well considered judgment and decree passed in O.S.Nos.88 and 182 of 2014 dated 29.01.2015 on the file of the I Additional Sub Court, Erode. C O M M O N J U D G M E N T The parties to the second appeals have entered into a compromise in and by which the respondent has agreed to sell the properties subject matter of the suit in O.S.No.88 of 2014 on the file of the I Additional Subordinate Judge, Erode to the son of the appellant one G.Saravanan and in turn the appellant shall pay a sum of Rs.6,00,000/- to the respondent on the date of execution of the sale deed. The respondent also has no objection to the appellant withdrawing the sum of Rs.95,200/- which is lying to the credit of the suit, O.S.No.88 of 2014 on the file of the 1st Additional Sub Court, Erode.

2. The Memorandum of Settlement is taken on file and the second appeals are disposed of on the terms of the Memorandum of Settlement and the terms of the Memorandum of Settlement shall form part of the decree.

3. Accordingly, the Second Appeals are disposed of. No costs. Consequently, the connected Miscellaneous Petition is also closed.
