Crl.M.P.No.6948 of 2023 in SUNDER MOHAN, J.

The petitioner had moved a bail petition in Crl.O.P.No.9706 of 2023 seeking bail for the offences registered under Sections 294(b), 323, 324, 506(ii) and 307 of IPC on the file of the respondent police in Crime No.139 of 2023 and this Court by order dated 05.05.2023, was pleased to enlarge the petitioner on bail with certain conditions.

2. Now the petitioner has filed the present Crl.M.P.No.6948 of 2023 seeking to modify the bail condition 6(b) imposed on him that the petitioner shall pay Rs.10,000/- (Ten Thousand only) directly to the victim and the acknowledgment for the same shall be produced before the Magistrate while executing bond.

3. Heard the learned counsel for the petitioner and the learned Government Advocate (Criminal Side) for the respondent. 1/3

4. Since it is represented that the victim has refused to receive the amount, the petitioner is directed to deposit the said amount to the credit of Crime No.139 of 2023 and on such deposit, the victim shall be entitled to file a petition/memo to withdraw the said amount.

5. Accordingly, this Criminal Miscellaneous Petition is ordered. The other conditions imposed on the petitioner shall remain unaltered. 11.05.2023 arb/jas Note: Issue Order Copy on 11.05.2023.
