The petitioner, who was arrested and remanded to judicial custody on 29.11.2024 for the offences punishable under Sections 454 and 380 of Indian Penal Code in C.C. No.138 of 2025 on the file of the District Munsif Cum Judicial Magistrate, Madathukulam, seeks bail. 2.

The case of the prosecution is that the petitioner had involved in break open of the defacto complainant's house and committed a theft of 19 sovereigns of gold jewels. Hence, this case. 3.

The learned counsel appearing for the petitioner submitted that the petitioner has been falsely implicated in this case and he is in judicial custody since 29.11.2024. It is further submitted that investigation of this case was competed and charge sheet filed in C.C.No.138 of 2025 on the file of the learned District Munsif Cum Judicial Magistrate, Madathukulam and the same is pending for trial. The learned counsel further contended that the petitioner has been in continuous judicial custody for more than 16 months and the petitioner is ready to abide by any conditions imposed by this Court. Hence, he prayed for the grant of bail to the petitioner 4.

The learned Government Advocate (Crl. Side) appearing for the 2/4

respondent, while opposing the bail to the petitioner, reiterated the prosecution's case and submitted that there are totally 5 accused involved in this case and the petitioner is arrayed as A1. He further submitted that 20 previous cases are pending against the petitioner. 5.

Considering the facts and circumstances of the case, the nature of the allegations, the fact that the petitioner has 20 previous cases, this Court is not inclined to grant bail to the petitioner. 6.
