Petition filed under Article 226 of the Constitution of India to issue a Writ of Certiorarified Mandamus calling for the records of the second respondent herein relating to the impugned dismissal order dated 18.02.2025 and the transfer certificate issued by the second respondent and to quash the same as it is in violation of the principles of natural justice and ultra vires to University and College Regulations and to consequently direct the second respondent to permit the petitioner to complete his studies in the college. 1/4

The petitioner has filed this writ petition seeking issuance of Writ of Certiorarified Mandamus calling for the records of the second respondent relating to the dismissal order dated 18.02.2025 and the transfer certificate issued by the second respondent and to quash the same as it is in violation of the principles of natural justice and ultra vires to University and College Regulations and to consequently direct the second respondent to permit the petitioner to complete his studies in the College.
2.There is no representation for the second respondent. 3.The impugned order dated 18.02.2025 reads as follows: "It is found that, there is a criminal case booked against you for which an FIR has been filed.
Due to this circumstances your continuation as a student in this institution is not permitted. Herewith we are enclosing the Transfer certificate."

4.It is the submission of the learned counsel appearing for the petitioner that prior to the issuance of such termination order, no opportunity of hearing was given to the petitioner. 5.According to the learned Standing Counsel appearing for the first respondent, there is no objection to the submissions made by the petitioner counsel.
6.I have given my anxious consideration to either side submission.
7.While looking at the impugned order dated 18.02.2025, there is no indication upon notice of hearing before passing the impugned order which is covertly and overtly exhibited in the impugned order which necessitated this Court to interfere with the impugned order. 8.In such view of the matter, the impugned order dated 18.02.2025 is quashed. This Court consequently direct the second respondent to permit the petitioner to attend the class. However, it is 3/4

pri made clear that the second respondent is at liberty to issue fresh proceedings, if so advised, by following due process of law. 9.The writ petition is disposed of. No costs.
