Respondents Prayer: Writ Petition filed under Article 226 of the Constitution of India, seeking for a writ of mandamus directing the respondent Nos.1 to 5 to consider and take appropriate action on the petitioner's representation dated 03.07.2015 thereby direct them to disburse the entire death benefits such as immediate monetary relief, Death gratuity, GPF & Deposit Linked Insurance Amount, Leave Encashment, pension and etc,, to the petitioner forthwith for the death of the petitioner daughter deceased R.Thilagavathy, who was working as P.G. Teacher [Chemistry] in Government Higher Secondary School, Kazhuperumpakkam, Vanur Taluk, Villupuram District and died in service on 16.10.2014.

O R D E R

By consent, the writ petition is taken up for final disposal. The daughter of the petitioner herein, viz., R.Thilagavathy, has joined the Tamil Nadu Educational services as P. G. Teacher [Chemistry] in Government Higher Secondary School, Kunnathur, Arani and she was given in marriage to the 6th respondent on 26.05.2010 and her marriage life was not happy and on 06.10.2014, she died in mysterious circumstances and since no case was registered, the petitioner approached this Court by filing Crl.OP.No.2240/2015 and this Court, vide order dated 12.03.2015 had directed the jurisdictional police officers to follow the Judgment of the Hon'ble Apex Court reported in 2015 [2] SCC 1 [Lalitha Kumari Vs. State of Uttar Pradesh]. However, no action has been taken so far.

The grievance now expressed by the petitioner that though in the service records, the petitioner's daughter entered the name of the petitioner's wife as her nominee, the death benefits have not been disbursed. In this regard, a representation dated 03.07.2015 has been submitted to the 3rd respondent and since no orders have been passed, the petitioner came forward to file this writ petition. Heard the submissions of the learned counsel for the petitioner and Mr.V.Subbiah, learned Special Government Pleader who accepts notice on behalf of the respondents 1 to 5. This Court, taking into consideration the limited scope of prayer sought for by the petitioner and without going into the merits of the same, directs the 3rd respondent to consider and dispose of the petitioner's representation dated 03.07.

2015 on merits and in accordance with law after putting on notice the 6th respondent and pass orders within a period of eight weeks from the date of receipt of a copy of this order and communicate the decision taken to the petitioner as well as to the 6th respondent. The writ petition is disposed of accordingly. No costs. Consequently, the connected miscellaneous petitions are closed.
