O R D E R
(Order of the Court was made by S.Manikumar,J) Petitioner has sought for a writ of mandamus, restraining the respondents, from shifting "Sangita Vadyalaya" from Chennai to New Delhi.
2. On this day, when the matter came up for hearing, based on the letter, dated 6/6/2019, Government of India, Ministry of Textiles, Office of the Development Commissioner (Handi-crafts), addressed to the writ petitioner, President, Southern Handi-craft Industry Association, Chennai, Mr.P.S.Arun Kumar, learned counsel for the petitioner submitted that the competent authority has given his consent that DCMI, at Chennai, be retained at its place along with instruments for the time being. Letter, dated 6/6/2029, of the Assistant Director (C & P), Ministry of Textiles, Government of India, reads thus:- No.K-12012/6/19/2015-16C&P/Pt-I/818 Government of India Ministry of Textiles Office of the Development Commissioner (Handicrafts) West Block No.7, R.K.Puram New Delhi 110 066 Dated: 6/6/2019 To Shri P.Subramanian President Southern Handicrafts, Industry Association No.F-8, 10th Street Sector - I, South Avenue Road Industrial Estate, Ambattur Chennai 600 058.
Sub: Shifting of ancient rare musical instruments museum maintained by DC (H), Chennai Office - A prideful culture heritage for South India is strongly objected by social activists and others - Request to drop the proposal of shifting out of Chennai - reg.
"Please refer to your letter No.SHIAssn/DC/2019-20, dated 18th May 2019, on the above cited subject.
In this connection, I am directed to inform you that competent authority has given his consent that DCMI should be retained at its place along with instrument for the time being, The issues with the approval of competent authority."
3. Though Mr.P.S.Arunkumar, learned counsel for the petitioner, insisted that musical instruments be retained permanently by Development Commissioner for musical instruments, we are not inclined to issue any such directions. In the light of the letter, dated 6/6/2019, directing retention of rare musical instruments by the Development Commissioner for musical instruments, at Chennai, instant writ petition is disposed of. No costs. Consequently, the connected Miscellaneous Petition No.15121 of 2019 is closed.
