Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus directing the 1, 2 respondents to consider the case of the petitioner for increase of Special Pension adequately as per the Consumer Price Index and fix appropriate amount of pension to the petitioner.

By consent, the writ petition is taken up for final disposal. 2.The petitioner is a retired Noon Meal Organiser and in the various Government Orders, time scale of pay, personal pay, special time scale of pay were granted and on 15.09.2008, special pension of Rs.500/-, Rs.600/- and Rs.700/- respectively was sanctioned to Helpers, Cooks and Noon Meal Organizers. The grievance expressed by the petitioner is that the payment of special pension is not linked to dearness allowance and hence it is very meagre and hence her case has to be looked in and the consumer price index prevailing has to be enhanced and in this regard, has submitted representation dated 31.07.2015 to the respondents and since no orders have been passed, came forward to file this writ petition.

3.Heard the submissions of the learned counsel appearing for the petitioner and Mr.R.Vijayakumar, learned Additional Government Pleader who accepts notice on behalf of the respondents. 4.This Court taking into consideration the limited scope of the prayer sought for by the petitioner and without going into the merits of the same directs the respondents 1 and 2 to consider and dispose of the petitioner's representation dated 31.07.2015 on merits and in accordance with law and pass orders within a period of twelve weeks from the date of receipt of a copy of this order and communicate the decision taken, to the petitioner.

5.The writ petition is disposed of accordingly.
