Petition praying that in the circumstances stated therein the High Court will be pleased to modify the condition imposed on the petitioner in Crl.M.P.NO.8160 of 2016 in Crl.A.NO.593 of 2016 on the file of this Hon'ble Court.
Order : This petition coming on for orders upon perusing the petition and upon hearing the arguments of MR.R.SHANMUGASUNDARAM, SENIOR COUNSEL FOR M/S.K.P.ANANTHA KRISHNA, Advocate for the petitioner and of Mr.K.SRINIVASAN, SPECIAL PUBLIC PROSECUTOR FOR CBI CASES, on behalf of the Respondent the court made the following order:- At the time of granting bail to the petitioner on 24.08.2016, this Court had directed him to deposit Rs.40,00,000/- in three installments as detailed below:
The 1st installment of Rs.5,00,000/- at the time of executing the bond before the trial Court. The 2nd installment of Rs.10,00,000/- shall be deposited within a period of four months and the 3rd installment shall be deposited within a period of eight months from 24.08.2016. The 1st installment of Rs.5,00,000/- has been deposited and the other conditions have not yet been complied with. 2.When the matter stood thus, the petitioner came up with a petition in Crl.M.P.No.13315 of 2016 for extension of time. This Court has considered the request made by the petitioner and accordingly, on 16.12.2016, for making payments in respect of 2nd and 3rd installment of Rs.10,00,000/- and Rs.25,00,000/-. This Court has granted three months time for making payment of Rs.10,00,000/-, from 16.12.2016 and in respect of 3rd installment of Rs.25,00,000/-, this Court has granted three months time from the date of payment of 2nd installment. But, this condition is also not complied with.
3. The learned Special Public Prosecutor has strenuously objected to grant extension of time. However, considering the submission made by the learned Senior counsel for the petitioner for complying with the condition in one time measurement, six months time is granted to the petitioner, to deposit the entire amount of Rs.35,00,000/- from today (i.e.,) from 16.03.2017. If the petitioner fails to comply with this order, the order of bail already granted in his favour on 24.08.2016 will automatically be cancelled without any further reference to this Court.
