Writ Petition filed under Article 226 of Constitution of India, to issue a Writ of Mandamus, directing the 1st and 3rd respondents to consider the application submitted by the petitioners on 19.03.2012, 28.12.2015 and last reminder dated 16.10.2017 for the grant of Patta to the land in S.No.141/12, measuring 1.80 acre in Nallakuttala Halli Village, Pappireddipatti Taluk, Dharmapuri District to him. Mr.P.Senthilvel, learned Government Advocate takes notice for the respondents. By consent of the parties, the main writ petition is taken up for final disposal at the admission stage itself.

2. Heard both sides.

3. The petitioners seek for a mandamus directing the first and third respondents to consider the representation dated 16.10.2017, wherein and whereby they sought for granting Patta in their favour in respect of the land S.No.141/12, measuring 1.80 acre in Nallakuttala Halli Village, Pappireddipatti Taluk,

The grievance of the petitioners is that even though they had applied for granting Patta as early as on 19.03.2012 and also on 28.12.2015, so far their request was not considered by the respondents. This Court, at this stage, is not expressing any view on the claim made by the petitioners, as it is for the third respondent to consider and decide the same. Thus, this writ petition is disposed of, only with a direction to the third respondent to consider the representation of the petitioners and pass orders on the same on merits and in accordance with law, after hearing the rival claimants, if any. Such exercise shall be done by the third respondent within a period of eight weeks from the date of receipt of a copy of this order. No costs.
