O R D E R

This petition has been filed to direct the respondent police to register the complaint dated 29.10.2015 entered as CSR No.271/2015 on the file of the respondent and immediately interrogate the persons involved in the offence under Sections 406, 420, 506(ii) of IPC and file the charge sheet.

2. The petitioners have lodged a complaint as against one Suresh and his wife Malathi stating that Suresh and Malathi were running chit business and collected Rs.28,00,000/- and also 10 1⁄2 sovereigns of jewels. When the petitioners asked for return of the same, the said Suresh told that they would settle the entire amount along with 10 1⁄2 sovereign jewel but they did not pay the same and cheated the petitioner. Hence, a complaint was lodged against the said Suresh and Malathi, for which, CSR.No.271/2015 was assigned. Since no progress has been made till date, the present petition has been filed. https://hcservices.ecourts.gov.in/hcservices/

3. Learned Additional Public Prosecutor submitted that since the amount involved is Rs.28,00,000/-, the competent authority to enquiry into the matter is the Central Crime Branch police.

4. In view of the submission made by the learned Additional Public Prosecutor, the respondent police is directed to transfer the complaint pending in C.S.R.No.271/2015 to the Central Crime Branch and the Central Crime Branch Police is directed to conduct an enquiry on the complaint in CSR.No.271/2015 and upon enquiry, if the materials are gathered indicating any cognizable offence, they are directed to proceed further in accordance with law as early as possible.

5. The criminal original petition is disposed of accordingly.
