This Criminal Original Petition has been filed to direct the second respondent to register the First Information Report on the basis of the complaint given by petitioner on 26.09.2019 before the 1st respondent.
2.The contention of the petitioner is that the petitioner came in contact with Ignatious Anthony @ Viki and they became friendly on one such occasion he informed that his mother is suffering from serious health issues and she needs to be taken into the petitioner's car viz. SWIFT ZDI bearing Registration No.TN 21 AS 0091 for his personal use. Thereafter, he had not returned back the car and whenever the petitioner asked he used to give one reason or other. had been pledged with one Hari Nadar, Siva and Kaabar and they refused to hand over the car and he was also threatened. 3.The learned Government Advocate (Crl. Side) submits that no such complaint has been received from the petitioner. Further submitted that the cars which are pledged with financiers for default it is taken away by the financiers. If the petitioner files a complaint before the respondents the same would be considered and action would be taken. 4.In view of the same, the petitioner is directed to submit the complaint along with the relevant documents of the car before the second respondent police and also directed to participate in the enquiry conducted by the respondent police. Thereafter on verification of the complaint the second respondent police shall proceed with the case. 5.With the above directions this Criminal Original Petition stands disposed of.
