O R D E R
(The case has been heard through video conference) The petitioner who are arrested and remanded to judicial custody on 19.07.2020 for the offence punishable under Sections 392 IPC in Crime No.504 of 2020 on the file of the respondent police seeks bail.
2. The case of the prosecution as per the defacto complainant Sangeetha is that on 08.07.2020, while she was traveling in her two wheeler, two persons came in a bike, have snatched her gold chain. Hence, the complaint.
3. The learned Counsel for the petitioner would submit that the petitioner is innocent and he has not committed any offence as alleged by the prosecution and he has been falsely implicated in this case and only after this case, he has been implicated by the respondent in various other cases. He would further submit that the petitioner has been suffering incarceration from 19.07.2020. Hence, he prays for grant of bail to the petitioner. https://hcservices.ecourts.gov.in/hcservices/
4.The learned Government Advocate (Crl.Side) would vehemently oppose stating that the petitioner is a habitual offender and taking into consideration of the previous cases pending against the petitioner, this Court vide its order dated 11.09.2020 in Crl.O.P.No.14124 of 2020 had dismissed his bail petition and there is no change of circumstances.
5.In view of the above submissions so made by the learned Government Advocate, this Court is not inclined to grant bail to the petitioner. This Criminal Original Petition stands dismissed accordingly.
