O R D E R

[Order of the court was made by M.M.SUNDRESH,J.] The Petitioner, who is the wife of the detenu viz. R.Ravichandran, has come up with this Petition, seeking production of the detenu, who is working as Assistant Professor in Dr.Ambedkar Government Arts College, Vyasarpadi, Chennai.

This Petition has been filed pursuant to the complaint dated 07.05.2019 made in Crime No.142 of 2019, that the detenu has been missing and that his Cell Phone was switched off from 06.05.2019 onwards. The complaint also proceeds to state that the detenu was in the Streets for the past few days, due to work pressure in the College. https://hcservices.ecourts.gov.in/hcservices/

Learned Additional Public Prosecutor produced documents today, which would disclose that the detenu was facing trouble in the College. A complaint was given by a Professor working in the College, raising various allegations, though not specifically pointed out to the detenu. The detenu was not going to the College from the date of re-opening.

Though the complaint states that from the date of examination, the detenu has switched off his phone, documents furnished would disclose that even thereafter, the detenu had sent a communication to the College authorities from his cell phone, with respect to the payment of dues to him. 5.

From the above, prima facie, we are of the view that there is no illegal detention involved in this case. It does not appear that the detenu has left the College apprehending some action against him. However, this Court is inclined to direct the 2nd Respondent to go on with the investigation and secure the detenu.

Accordingly, this Habeas Corpus Petition is closed, with a direction to the 2nd Respondent to proceed with the investigation, and as and when the detenu is secured, produce him before the Judicial Magistrate concerned. Sd/- Assistant Registrar(CS) //True Copy// Sub Assistant Registrar (aeb) To:
