ORDER
This Criminal Original Petition has been filed seeking a direction to the first respondent to investigate the case and file a final report in accordance with law in Cr.No.2029 of 2012.
2.The case of the petitioner is that the petitioner is doing a business in the name and style of "Ragavendra Enterprises", having showroom at No.41/52, K.K.Road, Venkatapuram, Ambatuur, Chennai and selling household articles, for the past 17 years.
The petitioner's friend viz., B.Venkateswaran had purchased Air conditions and LCD TV for the worth of Rs.1,90,00,000/-(Rupees one crore and ninety lakhs only) and he had repaid only a sum of Rs.90,00,000/-(Rupees ninety lakhs only). On several demand made by the petitioner to repay the balance amount, the said Venkateswaran has not paid the balance amount; but, he threatened the petitioner. Hence,
the petitioner has lodged a complaint before the first respondent-police. On receipt of complaint made by the petitioner, a case has been registered in Cr.No.2029 of 2012 dated 26.09.2012. Thereafter, the petitioner approached the Inspector of Police (law and Order) many times and gave information that the Venkateswaran sold the Electronic Goods to one Srinivasan having shop at J.K.Enterprises at Govindhan Street, West Mambalam, Chennai and even after the information, the Inspector of Police, Ambattur has not taken any steps to enquire the said Venkateswarn and the said Srinivasan till date. Hence, the petitioner has filed the present criminal original petition.
3.The learned Additional Public Prosecutor appearing for the respondents submitted that the investigation is still pending. They are ready to complete the investigation. Further, he submitted that the petitioner has not produced the relevant documents to the first respondent and also he is not co-operating with the first respondent for investigation. 4.Heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor appearing for the respondents.
5.In view of the submissions made on either side, this Court directs the petitioner to co-operate with the first respondent-police for investigation and produce all the relevant documents to the first respondent-police. On receipt of the same, the first respondent-police is directed to investigate the case in Crime No.2029 of 2012 and file a final report as early as possible. The Criminal Original Petition is ordered accordingly.
