This Criminal Miscellaneous Petition has been filed by the petitioner seeking to modify the condition imposed by this Court in the order dated 14.02.2023 passed in Crl.R.C.No.161 of 2023 that the petitioner shall execute a bond for a sum of Rs.5,00,000/- (Rupees Five Lakhs Only) for the return of vehicle viz., Auto Rikshaw bearing Registration No.TN25-BD-7785. 2.Heard the submissions made by the learned counsel for the petitioner and perused the materials available on record. 3.It is represented that the Trial Court is insisting for solvency certificate. Since the petitioner claimed to be the owner of the above said vehicle, he was directed to execute own bond for a sum of Rs.5,00,000/- (Rupees Five Lakhs Only) for the interim custody of the Auto Rikshaw bearing Registration No.TN25BD-7785 and therefore, the learned Trial Judge is directed to accept the own bond to be executed by the petitioner without insisting the solvency certificate and pass orders on merits and in accordance with law.
4.With the above observation and direction, this Criminal Miscellaneous Petition is allowed.
